RULES OF THE USE OF FORCE

Purpose

The purpose of this policy is to provide security personnel of Duguf Enterprise Security Services with guidelines and restrictions for the use of force, both Deadly Force and Non-Deadly Force. This policy is based on the highest standards of national, international guidelines and human rights law.

This policy applies to Duguf security employees as well as security contractors responsible for the protection of properties, premises and personnel of clients under Duguf protection.

Commitment to Human Rights

Duguf recognizes and respects the value and integrity of each and every human life.  It affirm that it has a responsibility to respect the human rights of, and fulfills humanitarian responsibilities towards, all those affected by its business activities, including Personnel, Clients, suppliers, shareholders, and the population of the area in which services are provided.

Duguf and its personnel also recognize the importance of respecting the various cultures encountered in its work, as well as the individuals they come into contact with as a result of those activities.

A Duguf Security personnel is always to bear in mind that when the use of force is unavoidable, he/she will act with restraint, respecting and preserving human life and causing the minimum harm to people and property. In no case shall the use of force exceed what is strictly necessary, and should be proportionate to the threat and appropriate to the situation.

The use of force training is considered as mandatory training for each Duguf personnel before any deployment to the field or assignment to an official duty. Moreover a refresher training of same course should be delivered to all Duguf personnel once in every year as a reminder to organization’s strong commitment to human rights and its strict policy toward using force.

Essential criteria for the Use of any Force

The following essential criteria must be applied before using any force;

  1. the force is reasonable, proportional to the threat offered and the minimum required to negate the threat; and
  2. The force is necessary, under all the circumstances known at the time, to negate the threat; and
  3. There is no other reasonable alternative available.

Criteria for the use of Deadly Force

Based on the three essential criteria mentioned above, Duguf security personnel may only use Deadly Force to defend him/her, other Duguf personnel and the clients he/she protects against an imminent threat of death or serious bodily injury and there is no other reasonable alternative available.

Criteria for the use of Non-Deadly Force

Based on the three essential criteria mentioned above, Duguf security personnel may use Non-Deadly Force:

  1. In defense of himself/herself, other Duguf personnel and the clients he/she protects against imminent threat of bodily injury.
  2. To maintain order and security within, and/or restrict access to Duguf and its clients’ premises; and prevent damage to Duguf client premises or property.
  3. To detain and/or prevent the escape of a person who constitutes a threat to order and security of its clients and/or who has committed a serious crime.

Decision to Use Force

As a first step in the use of force, security personnel should audibly instruct the subject to comply. If, however, giving such an instruction would pose a risk to the security personnel or others, it need not be given. When a decision is made to use force the security personnel should act decisively and without hesitation, using force proportional to the threat and the minimum required to negate the threat.    A Duguf security personnel is not required to place himself/herself or others in unreasonable danger before acting.

Post Application of Force

Once force has been applied and the threat negated, the security personnel must:

  1. Where feasible, arrange for appropriate medical aid to the person subjected to the use of force.
  2. Follow all relevant procedures, including reporting the incident to the supervisor, and cooperate with the investigation.
  3. Duguf management should report the incident to the government authorities, immediately handover the individual posing the threat to the concerned police and cooperate with any investigation related to the case conducted by the government’s law enforcement agencies.

A security personnel involved in the application of deadly or non-deadly force may be provided with stress and medical counseling as appropriate.

Definition

Deadly Force means any force that creates a substantial risk of causing death or serious bodily injury.

Non-Deadly Force means any use of force other than that which is considered deadly force. This includes any physical effort used to control or restrain another, or to overcome the resistance of another.

Serious Bodily Injury means physical injury which creates a substantial risk of death, or which causes serious and protracted (long-term) disfigurement, protracted impairment of health or protracted loss or impairment of the function of any bodily organ.

Bodily Injury means any physical injury other than that which is considered serious bodily injury.
